Mediation in modern legal practice

Abstract

We provide the characteristic of the current state and trends of the Alternative Dispute Resolution (ADR) system in Russia and abroad. We analyze the main features of current Russian legislation in the field of mediation. The necessity of integration of mediation in the Russian legal culture is proved. We propose measures of redefining the role of various representatives of the legal profession, designed to meet the challenges of time and provide legal assistance to citizens, using a wide range of possibilities for the resolution of the conflict, including the development of a mutually acceptable solution by the disputing parties that meets their interests. We separately consider the opportunities the mediation offers to judge, lawyer, notary and corporate lawyer. We describe a lawyer in the collaborative law process, (“mutual help law”) as a voluntary, structured, non- adversarial approach to resolving disputes based on cooperation of the parties themselves and their legal advisers.
