Abstract

The contribution analyzes the problems of motivation of human’s criminal behavior. Researches in this field are aimed at finding the laws of functioning of psyche and knowledge of how they determine the behavior of man in the various aspects of his activity. It examines different views on the source of human motivation which is united by the basic category of “need”. The contribution analyzes: a type of conative behavior of man such as criminal behavior, the relevance of the problem of study of motivation of the behavior of persons committing lucrative crimes; the need to take into account the motivation and peculiarities of behavior of persons committing the crimes with abovementioned motives, necessity of using a complex psychological and legal approach to investigation and judicial examination of crimes of this category; the problem of lack of uniform understanding of motives of criminal behavior in the theory of criminal law and among its practitioners.
