The right of children to live and to grow up in a family: from social analysis to the problem definition at the intersection of law and psychology

Abstract

Children’s right to live and grow up in a family is analyzed in this article in the context of social processes as the combination of actual changes in the outside world caused by the influence of family and legal norms, regulating this right. Existence of casual link between the current crisis in the realization and protection of the rights of children to be raised in the family and the development of norms of family law without taking into account the psychological aspects of this problem was proposed. As result of the study the symptoms of the crisis in area of protection of children’s rights under family law were described, it was indicated some issues that could put together the efforts of psychologists and lawyers to overcome the crisis situation so that family law in the sphere of protecting the interests of minors would not violate the limits of necessary and within reasonable frames it could ensure the most proper, fair and effective decisions.
