Penal measures of suppressing criminal counteraction during investigation process

Abstract

Suppressing criminal counteraction to investigation of crimes is a process which requires taking appropriate legal steps as well as making decisions based on criminal law. In this respect article 63 of Russian Federation Criminal Code should be changed as follows: “committing the crime, the indication of actus reus of which is counteraction towards administration of justice”. It is also necessary to correct the sanctions of articles 294, 296, 298 of Russian Federation Criminal Code which provide punishments for committed crime. Yet more paradoxical is another reality, which lies in the fact that criminal law currently in force is incapable of providing actual and sufficient defense to judges, investigators, etc. The situation is caused by imperfection of the mechanism of criminal safety provision for the mentioned officials.
