Abstract

Context and relevance. Mediation is a widespread form of conflict resolution with its own unique principles. Restorative justice, as a new paradigm in criminal justice, utilizes mediation as a form of implementation while adapting it to its own core concepts. Objective. The study aims to identify the differences between the value foundations of classical and restorative mediation. Hypothesis. Restorative mediation, as a form of restorative justice, possesses significant distinctions from classical mediation. Methods and materials. The research involves an analysis of scientific publications on classical mediation, restorative mediation, and restorative justice, as well as a formal legal analysis of Russian regulatory acts governing mediation in legal proceedings. Results. The study reveals that restorative mediation differs substantially from classical mediation due to divergent underlying values. Restorative mediation is defined by the values of the restorative justice paradigm, which focus on reparation of harm, awareness of the consequences of the offense, healing of the victim, and the restoration of damaged social relationships. Conclusion. It is demonstrated that studying value foundations provides a crucial explanatory framework for interpreting the practical application of mediation across various case categories. Restorative mediation is not merely a technology for reaching an agreement, but rather a form of democratic participation by civil society, the goal of which is the humanization of criminal proceedings. A lack of understanding of these differences leads to a value imbalance and hinders the implementation of restorative practices in Russia.
