Correlation Between Convicts' Psychological Perception of Amnesty and the Rate of Recidivism

Abstract

This article deals with recidivism of amnestied persons in Russia in conjunction with convicts' psychological perception of amnesty. We identify the specifics of legal nature of amnesty in comparison to other forms of early release. The authorial method of studying the recidivism of pardoned persons is suggested in view of calculating its factor. In the article we analyze the personality characteristics of amnestied persons bearing relevance to non-release of the convicts who are prone to delinquent behavior. We cover the problem of violation of rights of people affected by the crimes of persons who are subject to an amnesty. Measures have been developed to lower the scale of negative impact of amnesty on the society while taking into account its legal nature. It was concluded that one of the reasons of negative social implications of granting an amnesty can be misperception of its goals on the part of convicted persons as well as low educational and motivational value of certain amnesty acts.
