The Use of Digital Franchising in the Implementation of Educational Programs in the Intellectual Property Field

Abstract

Digital franchising of educational services represents the type of the public relations which is used at implementation of various educational programs at which can join in a complex of the exclusive rights transferred by the franchisee's franchiser under the contract of the complex enterprise license developed by the owner and adapted for a concrete franchise taking into account the purposes and problems of training, the system of distance learning, including electronic educational and methodical complexes with working programs, video lectures, manuals, the methodical recommendations, workshops and also a set of tools for carrying out the current and final control of knowledge. Standard forms of franchise agreements: complex business license - in the Republic of Belarus, commercial concession - not approved at the legislative level in the Russian Federation, which indicates the need to develop legislative regulation of franchise legal relations in general, both as a type of obligation in civil law, and as a specific form of entrepreneurial activity in the provision of paid educational services, including digital franchising in the implementation of educational programs in the field of intellectual property. Digital educational franchising is considered as a specific type of franchise legal relationship, in which the copyright holder uses a licensing complex, which includes already developed work programs in accordance with educational standards for training specialists, and franchisees are required to implement them in a specific territory for the period stipulated by the franchising agreement.
